Gift Card Terms and Conditions

§1 Subject of the Terms and Conditions

1. These Terms and Conditions specify the conditions for acquiring and using VES.point gift cards, in particular the rights and obligations of customers and the scope of liability of the card issuer.

§2 Glossary

The terms used in the Terms and Conditions mean:

1. Issuer – VES Mariana Kozova, registered in the Central Register and Information on Economic Activity maintained by the competent minister for economy, at the address Andrzeja Struga 18, 26-600 Radom, Tax ID (NIP) 9482633115, REGON 521637027, conducting online sales on the website www.vespoint.eu;
2. Card – electronic VES.point gift card issued to the bearer, enabling online purchases on the website www.vespoint.eu for 6 months from the date of purchase;
3. Customer – person who has acquired or holds the card;
4. Account – a designated part of the Online Store assigned to a given Customer, through which the Customer can perform specific actions within the Online Store;
5. Consumer – a natural person making a purchase not related to business or professional activity;
6. Terms and Conditions – this document;
7. Balance – the amount of funds available on the card;
8. Store – VES.point online store at the address www.vespoint.eu.

§3 Acquisition of the Card

1. The card can only be purchased online via the online store www.vespoint.eu. After purchase, the card in PDF format is sent to the provided email address within 24 hours on business days. In case of urgent need, the customer may contact us via email or Instagram.

2. The card can be loaded with an amount from 100 EUR to 900 EUR.

3. The fee for the card cannot be paid with another gift card.

4. The card is neither refundable nor exchangeable for cash, unless otherwise stipulated by applicable law.

5. The card is not subject to any discounts or promotions and cannot be combined with other discounts available on the Seller’s website, including, for example, free shipping for orders from 100 EUR.

§4 Payment with the Card

1. The card can only be used for online purchases in the store www.vespoint.eu before placing an order.

2. If the cart value exceeds the card balance, the customer may pay the difference using another payment method, e.g., PayPal.

3. If the cart value is less than the balance, the remaining amount stays on the card for use in future transactions.

4. Only one gift card can be used per order.

5. The card cannot be used to purchase another gift card.

§5 Rights and Obligations of the Customer

1. The purchaser should protect the card from access by unauthorized persons.

2. The customer can check the balance by contacting the store’s customer service via email at info@vespoint.eu.

3. The card will not be replaced in case of loss or damage to the PDF file.

4. In case of a return of goods paid with the card, the refund amount is credited back to the same card (if still valid) or a new card is issued for the refund amount. The validity period is not extended.

§6 Rights and Liability of the Issuer

1. The Issuer may refuse payment with the card if:

1. the card’s validity period has expired;
2. the balance is 0 EUR;
3. there is suspicion of forgery or unauthorized modification of the card.

2. After the validity period expires, the unused balance is forfeited.

3. The Issuer reserves the right to temporarily suspend the use of cards in case of technical failures or store upgrades, with customers being notified if possible.

§7 Complaint Procedure

1. Complaints should be submitted via email to info@vespoint.eu with a description of the issue.

2. The Issuer will process the complaint within 14 days of receipt, or for consumers within the legally prescribed period, unless additional information is required – in which case the period starts upon its provision.

3. The above does not limit the rights of consumers under applicable law.

§8 Final Provisions

1. The Terms and Conditions are available on the website www.vespoint.eu.

2. The Issuer may amend the Terms and Conditions, but changes will not affect the rights of purchasers of already issued cards.

3. Changes take effect 7 days after the publication of the new version of the Terms and Conditions.

4. The Terms and Conditions take effect on 27.04.2025.

5. Matters not regulated herein are governed by Polish law. Disputes are resolved by the court competent for the Issuer’s registered office, unless consumer regulations provide otherwise.
